国际组织与成员国法律责任多重归属问题研究

国际组织和成员国的法律责任归属问题一直以来都是国际法争论的话题。政府间国际组织作为一类国际法主体,应独立承担法律责任。但在实践中,成员国在执行国际组织决议的过程中往往滥用国际组织法律人格,其行为不仅是国际组织法律人格的体现,还代表了自己的意志,造成法律责任归属不明。以此种争议情形为研究对象,结合1999年的使用武力合法性案,2007年欧洲人权法院的拜拉米案和萨拉马提(Behrami/Saramati)案、阿尔吉达(Al-Jedda)案以及2014年海牙法院关于斯雷布雷尼察(Srebrenica)诉荷兰案的相关判决,借鉴国外学者近几年的相关研究,认为应当坚持国际组织和成员国法律责任的多重归属。围绕责任多重归属原则的确立过程,通过对2011年《国际组织责任条款草案》相关条文的分析,明确了行为归属与责任归属的关系:只有确定行为归属之后,才能确定责任归属;为了最终确定责任的多重归属,提出以有效控制为标准认定行为归属,并明确这种有效控制是对具体行为的事实控制。     

Measures of accountability and delegated discretion in activation work: lessons from the Norwegian Labour and Welfare Service

Activation work – the complex task of motivating, compelling and assisting marginalized citizens into labour market participation – pinpoints critical issues of discretion and accountability in the welfare state. Investigating accountability measures aimed at ensuring qualified discretionary judgements is therefore important. In this article, I discuss the reformed Norwegian Labour and Welfare Service and the accountability measures aimed at discretionary judgements of frontline workers. The conclusion is that, because activation tasks in the Norwegian frontline service imply professional discretion more than administrative discretion, structural measures aimed at restricting the discretionary space of frontline workers seem to have only limited impact. This is because the knowledge necessary to perform means – end judgements is insufficient. Rather, there seems to be a need for epistemic measures aimed at improving the knowledge base for professional discretionary reasoning.     

Mapping movement landscapes in South Africa

ABSTRACT

The concept of a movement landscape is used to analyse continuities and changes in popular mobilization since the end of formal apartheid. Focusing on four different episodes of protest since 1997, the article examines their relationship to the ANC movement and traditions, and their organizational forms. It finds a general theme of fluid and ephemeral organization, and a distrust of formal hierarchal organization, that is relatively new in South Africa. The Marikana strikes produced the most far-reaching organizational realignments, while the student struggles generated the most innovative re-imaginings of political forms and discourses. It concludes that although there have been critiques of and challenges to the ANC tradition, and experiments with new forms of organizing, they have not produced alternatives that have lasted or dislodged the dominant approaches defined and popularized by the ANC movement.

流程、合规与操作风险管理

商业银行风险管理研究中“违规活动—操作风险—信用风险”风险链条尚未得到足够重视． 巴塞尔委员会全面风险管理框架下的众多风险是分层次的，最底层是合规与操作风险，合规与操作风险做到位能极大降低其他风险发生的概率． 以往由于缺少数据支撑，信用风险的合规与操作风险动因无法建立，本文基于“流程—节点—风险点—控制措施—违规事件”关联模型，建立了合规与操作风险的动因库和损失数据库，并在理论上对风险链条上的风险传递关系进行初步探索． 首先基于流程对合规与操作风险动因进行解析，寻找深层次的人员违规和操作风险动因; 其次，探讨了金融机构如何通过业务流程再造改善合规与操作风险管理; 最后是基于流程的操作风险量化建模． 基于实践，总结提炼了“三位一体”的金融机构合规与操作风险管理模式，包含理论基础、信息系统和保障机制，该模式在诸多金融机构中得到运用，并取得显著成效．     

‘Nothing about us without us’: the emerging disability movement and advocacy in China

The disability movement and disabled persons’ self-help organizations (DPOs) are emerging in China, some of which succeeded in promoting policy and social changes with special strategies. Based on an original survey and interview, this article explains the development and survival strategies of China’s DPOs, and especially interprets some successful cases of social advocacy and policy advocacy in the emerging disability movement. It is hoped that scholars will pay more attention to the advocacy and public engagement of the disability community in non-western settings in the future.
